In today's Britain, public demonstration is no longer a fundamental right. Instead, it has become a conditional permission that those in power grant or withhold as they see fit. This represents the implication of new regulations that the current government is advancing, which would dictate the timing and location demonstrations can occur, with possible imprisonment for those who defy these restrictions.

Erosion of Civil Liberties

Earlier administrations had already weakened this fundamental freedom: the former Conservative government had granted law enforcement extensive additional powers, which global rights bodies had censured as "serious and undue restrictions" on civil liberties. Taken together, these incremental assaults on freedom have effectively eliminated the historically earned right to freedom of protest.

Using Tragedy to Justify Suppression

The latest restrictive measures are being justified by citing last week's heinous anti-Jewish assault on a British Islamic center. There should be universal agreement that the security of Jewish communities in Britain must be protected. However, using this horrific incident as a justification to stifle opposition is not only disconnected to that responsibility but perverts it.

"When you cannot draw the line at mass killing, you likely can't draw the line at democratic principles," commented a well-known American author, whose words that rings true for the present administration.

Historical Perspective of Demonstration

Reflect on Britain's rich history of protest and direct action against racism and authoritarianism, from the 1936 Battle of Cable Street to after World War II Jewish groups opposing fascism and the 1970s mobilizations against the National Front. Many of these historical demonstrators were labeled as extremists in their time, even while they were advocating the rights of marginalized groups.

Present Situation

In the current complex situation, here's what's actually happening: The Israeli government – a foreign state – is perpetrating what United Nations investigations have characterized as systematic destruction. Its warfare have led the International Criminal Court to issue legal indictments against Israel's prime minister and his ex-military leader.

International popular sentiment has shifted dramatically against Israel's military campaign. In Britain, a substantial majority of the public think Israel has likely committed war crimes. Most people would endorse a total prohibition on weapons exports to the nation, and approve the arrest of the Israeli leader.

Suppressing Opposition

Having essentially failed the public debate, pro-Israel advocates are now seizing on a vile anti-Jewish attack to try to silence a mass movement against a ethical disaster. The British government appears to be involved in this effort. Ministers have not enacted extensive restrictions on Israel and have allowed arms exports to proceed.

People who are protesting against the erasure of Gaza have been characterized as dangerous radicals. Yet there's a significant reason why there hasn't been a broader suppression on these demonstrators until now: extremely few protesters have made truly offensive statements about Jewish people, giving police authorities minimal reason to intervene.

Merging Jewish identity with the actions of the government of Israel is not only cynical but also dangerous. The official definition of anti-Jewish prejudice, accepted by the British government and numerous institutions, has been appropriately questioned for potentially restricting valid commentary of Israel. However, there should be universal agreement about one of its key examples: that "making Jewish people generally accountable for decisions of the state of Israel" constitutes antisemitism.

Escalating Restrictions

This is why we've reached a point where police authorities can suggest that protests criticizing Israel's policies should be called off because they might "inadvertently or deliberately" support antisemitism. Similarly, government officials have stated that acknowledgment of Palestinian statehood has made political parties "complicit" in alleged abuse faced by Jewish communities.

Inconsistent Treatment

On the same day as the synagogue attack, the Israeli military killed numerous of Palestinians in Gaza – increasing the terrible count from 24 months of daily atrocities that have claimed many thousands of lives. British politicians and news organizations have barely concealed the limited value they attach to Palestinian existence. This represents one of the boldest demonstrations of racism in contemporary society.

Breaking Boundaries

Our government has already crossed a concerning boundary by proscribing a specific activist group, a non-violent, human rights-focused direct action organization. Multiple thousands of British protesters have been detained, mostly for holding placards against mass killing and supporting the banned organization. Many of those detained are elderly citizens; among them a former clergyman and the child of a World War II genocide survivor.

Global Comparisons

It's not difficult to see where this trajectory leads. In the United States, political leaders helped demonize demonstrations supporting Palestine: a ex-political leader suggested that some were "linked with" other nations, while the current president described such demonstrations as antisemitic. In taking these actions, they helped legitimize the authoritarian crackdown on such demonstrations – and on freedom of expression in general.

Looking Ahead

If a conservative administration comes to power, it would be given sweeping powers to suppress dissent. What might a new administration do with this restrictive framework? Our forebears fought, suffered and died to establish our freedoms. We may ultimately regret how easily we allowed them to be eroded.
