The Grunge Band Once More Prevails in Legal Battle Over Iconic Nevermind Artwork
A US judge has once again thrown out a legal claim filed by a man who claimed that the rock band circulated exploitative images by using a photograph of him as a naked infant diving on the cover of their landmark 1991 record the album.
Court Rules Image Cannot Be Considered Pornographic
US District Judge Fernando Olguin dismissed the lawsuit initiated by claimant Spencer Elden after determining that no sensible jury would deem the image as obscene.
“Aside from the fact that the claimant was unclothed on the album cover,” no element “approaches bringing the photograph within the scope of the exploitation law,” the judge stated.
Legal Process and Reaction
Attorneys for Elden did not promptly reply to a request for statement. Nirvana’s attorney their counsel expressed they were “pleased that the judge has ended this baseless lawsuit and cleared our artistic members of the taint of false claims.”
The parties named comprised remaining band members Dave Grohl and Krist Novoselic, late vocalist Kurt Cobain’s wife the executor, and photographer Kirk Weddle.
Origins of the Legal Dispute
The legal action stemmed from the group’s use of a photo taken by the photographer at the a swimming facility in the state, which depicted the plaintiff swimming without clothes toward a currency on a fish hook. Elden, currently in his thirties, initially took legal action against the band and its record company the corporation in 2021, accusing them of sexually exploiting him through his portrayal on the cover and causing continuing emotional injury.
Previous Court Rulings
Olguin had earlier dismissed the matter in 2022 after finding that Elden’s claims were outside the statute of limitations without addressing the substance of his arguments. The 9th Circuit later reversed that ruling in 2023.
Olguin ruled on Tuesday that the photograph could not be considered as child pornography, likening it instead to a “snapshot of a unclothed infant bathing.”
